Exemptions...why do some need one (some)? Ex·emp·tion - noun the process of freeing or state of being free from an obligation or liability imposed on others. Exemptions offer relief from an FAA regulation. What Exemptions are currently available for drone FAA regulations? Over 55lbs Before the new fast track, an exemption for each drone edition had to be obtained, and it took months and months for each new drone premiered to the market. Now, if the drone is on the 137 drone list, its under all Exemption. Lately, social media is talking about more exemptions, including Night Operations, No Visual Observer, and Swarming Multiple Drones. But you cant put exemptions against a 137 you dont have yet. Pilots have 1 or 2 options: File for your 44807 and all three exemptions at once File for your 44807, and after receiving your 137, file for 1, 2, or all 3 exemptions. Exemptions defined: Night Operations If you are under 55 and the drone is operating under Part 107 without any night restrictions in your Exemption, you can fly at night according to regulation 107.29. You no longer need a night waiver unless you want to fly without anti-collision lights. Over 55, the FAA recently granted the Exemption for Part 91 operations. Now, all pilots can be approved for night operations by filing and receiving the Exemption under a summary grant of the original approved Exemption. Swarming Operations Swarming is defined as a single pilot flying multiple UAS drone operations. Under 55, these operations require a 107.35 waiver. Over 55, the FAA can approve swarms, and the process is the same as above. Visual Observer Visual Observers are defined as individuals designated to ensure that unmanned aircraft systems (UAS) operate safely and without obstructions. For UAS operations Part 107 for individuals under 55, Visual Observers are not usually required, unless specified under sections 107.31 and 107.33. Over 55, Visual Observers operate under Safety of Flight regulations.
